Terms of Service

Welcome to GasTrack PH. By accessing or using our website at gastrackph.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using the Service.

If you do not agree with any part of these Terms, you must stop using the Service immediately.

1. Description of Service

GasTrack PH is a free, community-driven web application that allows Filipino drivers to:

• View and compare community-reported fuel prices at gas stations across the Philippines
• Calculate estimated fuel costs for trips using Google Maps routing
• Log personal fuel fill-ups and track spending and efficiency over time
• Report fuel prices at nearby stations to help the community

The Service is provided free of charge. We reserve the right to introduce optional premium features in the future.

2. Eligibility

You must be at least 13 years of age to use the Service. By using GasTrack PH, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization or company, you represent that you have the authority to bind that organization to these Terms.

3. User Accounts

Some features require a free account. When you create an account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and not share it with others
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activity occurring under your account

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

4. User Obligations and Prohibited Conduct

When using GasTrack PH, you agree not to:

• Submit false, misleading, or inaccurate fuel price reports
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service without written permission
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Upload or transmit viruses, malware, or any malicious code
• Harass, abuse, or harm other users
• Use the Service for any illegal purpose under Philippine law
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the Service

5. Community Price Reports

By submitting a fuel price report, you:

• Represent that the information is accurate to the best of your knowledge
• Grant GasTrack PH a non-exclusive, royalty-free, perpetual license to display and distribute that price information to other users of the Service
• Understand that submitted prices become part of the community database and may be displayed publicly

We reserve the right to remove any price report that we reasonably believe is inaccurate, abusive, or in violation of these Terms.

6. Fuel Cost Estimates — Important Disclaimer

GasTrack PH provides these estimates for informational and planning purposes only. We make no representation or warranty that the estimates will match actual costs incurred. You should verify fuel prices directly at the station before making any purchasing or travel decisions.

7. Fuel Price Data Accuracy

Fuel prices displayed on GasTrack PH are sourced from community reports submitted by users, and may be supplemented by reference prices from the Department of Energy (DOE) of the Philippines. We do not independently verify every price report.

Prices may be outdated, inaccurate, or reflect temporary promotions. GasTrack PH is not responsible for any financial loss, inconvenience, or damage arising from reliance on price data shown on the platform.

8. Intellectual Property

All content on GasTrack PH — including but not limited to the logo, design, source code, text, and graphics — is the property of GasTrack PH and is protected under applicable Philippine intellectual property laws, including Republic Act No. 8293 (Intellectual Property Code of the Philippines).

You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

9. Limitation of Liability

To the fullest extent permitted by Philippine law, GasTrack PH and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Service
• Reliance on any fuel price data or trip cost estimate displayed on the platform
• Unauthorized access to or alteration of your data
• Any interruption, suspension, or termination of the Service

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose or non-infringement.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using GasTrack PH, you consent to the collection and use of your personal data as described in the Privacy Policy, in compliance with the Data Privacy Act of 2012 (RA 10173).

11. Termination

You may stop using the Service and delete your account at any time via the Settings page.

We may suspend or permanently terminate your access to the Service, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or abusive behavior, or if required to do so by law.

Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, and limitation of liability) will continue to apply.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
